Terms and Conditions

By purchasing products from this website (the "Site"), you agree to the following Terms and Conditions of Sale.

  1. Warranty
    Debbie Mackinnon (ABN 72 375 204 531) warrants that all artworks are original works created by her and that all descriptions are accurate.
  2. Copyright
    All artwork is the exclusive property of Debbie Mackinnon and is protected by Australian copyright law (Copyright Act 1968) and applicable international copyright and trademark laws.
  3. Pricing

    1. All prices are shown in Australian dollars.
    2. Prices for works on paper include delivery and handling within Australia unless otherwise stated.
    3. Artwork displayed without a price is available on request. Please use the enquiry form to obtain pricing.
    4. Accessories shown in photographs are not included unless specifically stated.
    5. We reserve the right to correct pricing or publishing errors.
  4. Ordering
    Once an order has been confirmed, the customer agrees to purchase the items in their shopping cart, including any applicable shipping charges. Orders for in-stock items are normally dispatched within seven business days after payment has been received.
  5. Shipping
    Artwork will be carefully packaged and shipped once full payment has been received. Shipping is included in the advertised price for works on paper. These works are shipped rolled in a sturdy postal tube and should be flattened before framing.
  6. Stock Availability
    While every effort is made to keep information accurate, artwork availability cannot always be guaranteed. Colours may vary slightly depending on your screen. If an artwork cannot be supplied, a full refund will be provided. For enquiries please email debbie@debbiemackinnon.com.
  7. Products Sent to an Incorrect Address
    If you have not received your order within 30 days, please contact Debbie Mackinnon within 30 days of purchase.

    • If an incorrect address was used due to our error, we will resend, replace or refund the artwork.
    • If an incorrect or incomplete address was supplied by the customer and the artwork is returned, it can be resent once additional postage has been paid.
    • If the artwork is not returned, no further liability is accepted.
  8. Unclaimed Products
    If an order is returned and cannot be delivered, and the customer cannot be contacted or does not respond within three months, ownership of the artwork will revert to Debbie Mackinnon.
  9. Delivery Delays
    Debbie Mackinnon is not liable for any loss or damage arising from delays outside her reasonable control.
  10. Passing of Risk and Ownership
    Ownership passes to the purchaser once the artwork has been dispatched. Copyright remains with Debbie Mackinnon.
  11. Returns and Refunds
    Refunds are only available where artwork received is materially different from its description. Returns will not be accepted simply because the purchaser changes their mind after delivery.
  12. Limitation of Liability
    Except as required by Australian Consumer Law, Debbie Mackinnon is not liable for incidental, indirect or consequential loss arising from the purchase of artwork. Returned artwork must be received in its original condition, with return shipping and insurance paid by the purchaser.
  13. Disclaimer
    To the fullest extent permitted by law, Debbie Mackinnon excludes liability for any loss or damage arising from the use of this website, including errors, interruptions, unauthorised access, viruses, linked websites or any reliance placed upon information contained on the Site.
